Terms of Service

Welcome to baligoldenvisaagent.com (“Website”), operated by Bali Golden Visa Agent (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our Website and the consulting services we provide (collectively, “Services”). By accessing or using our Services, you signify that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Bali Golden Visa Agent. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

1. Scope of Service

Bali Golden Visa Agent provides professional consulting, advisory, and facilitation services for individuals seeking to apply for the Indonesian Golden Visa and other related visas. Our Services include, but are not limited to, providing information regarding visa requirements, assisting with the preparation and review of application documents, guiding clients through the submission process, and acting as a liaison with relevant Indonesian government authorities on your behalf, where permissible.

Important Disclaimer: While we strive to provide accurate information and expert guidance, we operate solely as a consulting and facilitation agency. We facilitate the application process; however, we do not have the authority to issue visas or guarantee their approval. The final decision to approve or reject any visa application, as well as the processing times, rests solely with the relevant Indonesian government authorities (e.g., Directorate General of Immigration, Ministry of Law and Human Rights). We are not responsible for any changes in government policy, regulations, processing fees, or delays that may occur during the application process. Our role is to maximize the chances of a successful application by ensuring compliance with known requirements at the time of service, but we cannot be held liable for outcomes outside our direct control.

2. Client Responsibilities

As a Client, you are solely responsible for providing accurate, complete, and truthful information and all required documents in a timely manner as requested by us. You warrant that all information and documents provided are genuine and do not contain any false statements or misrepresentations. You understand that submitting fraudulent or misleading information can lead to the rejection of your application, forfeiture of fees, and potential legal consequences by the Indonesian authorities. You also agree to cooperate fully with our team and respond promptly to requests for information or documentation. Failure to do so may result in delays or rejection of your application, for which we bear no responsibility.

3. Fees and Payment

Our service fees for consultation, application preparation, and facilitation are clearly outlined in our service agreements or proposals, which will be provided to you separately. These fees cover the professional services rendered by Bali Golden Visa Agent. Please note that our service fees do not include government application fees, biometric fees, translation costs, notary fees, courier charges, or any other third-party costs associated with your visa application. These additional costs are the sole responsibility of the Client and must be paid directly to the respective third parties or reimbursed to us if we facilitate such payments on your behalf. All fees are typically quoted in United States Dollars (USD) or Indonesian Rupiah (IDR) and are subject to change without prior notice, although we will endeavor to inform you of any changes before they affect your specific application. Payment terms, including deposit requirements and installment plans, will be specified in your service agreement.

4. Refund Policy

Our comprehensive Refund Policy is detailed in a separate document and is available upon request. Generally, service fees paid to Bali Golden Visa Agent are non-refundable once the services have commenced or a significant portion of the work has been performed, regardless of the outcome of your visa application. This is because our fees compensate for the time, expertise, and resources expended in providing consulting and facilitation services. Government application fees, once submitted to the authorities, are typically non-refundable by the government, irrespective of the application’s approval or rejection. We encourage you to review our Refund Policy carefully before engaging our Services.

5. Limitation of Liability

To the fullest extent permitted by law, Bali Golden Visa Agent, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage. In no event shall our total liability to you for all damages, losses, and causes of action exceed the total amount of fees paid by you to Bali Golden Visa Agent for the specific service from which the claim arose.

6. Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms (other than for delay in the payment of money due and payable) for causes beyond its reasonable control and without its fault or negligence. Such causes may include, but are not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor or materials. In the event of such delay, the time for performance shall be extended for a period equal to the time lost by reason of the delay.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be settled through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within a reasonable period, the parties agree to submit to the exclusive jurisdiction of the competent courts located in Indonesia.

8. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.

9. Severability

If any provision of these Terms is found to be unenforceable or invalid by any court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

10. Entire Agreement

These Terms, along with any separate service agreement, proposal, or Refund Policy provided by us, constitute the entire agreement between you and Bali Golden Visa Agent regarding the use of our Services and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral, concerning its subject matter.
